1. Hello Kitty and Hello Barbie Have Hackers Saying “Hello” To Children’s Personal Information
The end of 2015 has seen a worrisome trend in data security, with the personal information of children becoming available to hackers due to data security issues with the much-beloved American and Japanese toys Barbie and Hello Kitty.
Talk back toys allow children to speak to toys that send audio files over the Internet to a server, where responses are generated. Bluebox Security issued a report finding a number of vulnerabilities with the app and the Wi-Fi network that messages were sent over, making it easy for hackers to steal data, including children’s audio recordings.
Two app developers, LAI Systems, LLC and Retro Dreamer, are accused of violating the Children’s Online Privacy Protection Act (COPPA) Rule. LAI Systems will pay $60,000 in civil penalties, and Retro Dreamer will pay $300,000. (Bloomberg)

2. Congress Passes U.S. Spending Bill to End Oil Export Ban
Congress passed a $1.1 trillion spending measure that averts a U.S. government shutdown and ends a 40-year-old ban on crude oil exports, a plan that ensures fiscal peace in Congress through most of 2016.
The Senate passed the bill 65-33 on Friday, shortly after a 316-113 House vote. The legislation, which will finance the government through September 2016, went to President Barack Obama, who signed it. (Bloomberg)

起因正是上个世纪70年代阿拉伯国家对西方国家实施的石油禁运（oil embargo）。面对飙升的油价和高度依赖石油的工业经济，美国政府开始采取措施，一方面控制石油产品消费，另一方面限制原油出口。其后在1920年《矿产租让法案》（Mineral Leasing Act of 1920）的基础上，美国通过了1975年《能源政策和保护法案》（Energy Policy and Conservation Act of 1975）和1979年《出口管理法》（Export Administration Act of 1979），要求原油出口须获得许可，并在工业和安全局（Bureau of Industry and Security，BIS）的《出口管理规则》（Export Administration Regulations）的供应短缺控制中明确了对原油出口的限制。只有极少数不受许可限制的例外情况，例如阿拉斯加库克海湾生产的原油、出口到加拿大并在加拿大境内消费的原油、加利福尼亚生产的小部分重（稠）油等。
政策上的限制，加上商业上的利益考虑，导致美国原油出口从那时开始几乎可以忽略不计。不过对于煤、天然气和石油产品等其他能源物资，却并没有过多限制，可见原油（注意是地下开采出来、未经裂解处理的原油，不是汽柴煤油等）的战略物资地位。下表是从1973年阿拉伯国家对美国石油禁运以来的美国能源出口情况，其中主要的三大出口能源从上到下依次是石油产品、天然气和煤。
近些年来，美国石油工业随着新的开采技术的发展而出现新的春天，石油产量不断提高。但由于这些法律政策的限制，加上作为美国最重要原油贸易集散地、管道运输中转枢纽和WTI原油期货交割地的库欣（Cushing）地区的管道设施等条件制约，导致WTI价格与Brent之间经常出现很大的价差，美国国内石油生产者的利益受到损害。因此随着美国石油产量逐步提高，经济利益已经逐步要求摆脱法律政策上的枷锁，一些石油公司开始利用政策漏洞以凝析油（Condensate）名义进行出口，相关石油开采行业利益团体也一直在游说（Lobby）国会解除石油出口禁令。现在，他们终于如愿以偿了。
在众议院以316票对113票、参议院65票对33票通过后，美国总统奥巴马周五签署了政府支出及税务法案，正式解除了长达40年的原油出口禁令。对美国党派来说，该禁令的解除是代表大石油公司利益的共和党的胜利，不过民主党在太阳能和风能税收等环境保护措施上也获得了交换利益。听起来，共和党代表造成环境污染和气候变化的石油公司的利益，是个大坏人；民主党为清洁能源呼吁，是个大好人，不过真正的利益在哪里？那些享受清洁能源政策优惠的大企业又是谁的？无利不起早，政治是交换。
3. Nigerian farmers cleared to sue Shell in Dutch court
Nigerian farmers will have the chance to sue oil multinational Shell in a Dutch court for pollution they blame on leaking pipelines, a Dutch appeals court ruled Friday. Activists said the ruling sets a landmark legal precedent that clears the way for Dutch-based companies to be sued for alleged negligence of their subsidiaries elsewhere in the world. There is now jurisprudence that means victims of human rights violations or pollution can sue Dutch multinationals in the Netherlands, said Geert Ritsema of the Dutch arm of Friends of the Earth, the environmental group that is also involved in the case. “It cannot be established in advance that the parent company is not liable for possible negligence of the Nigerian operating company," The Hague Appeals Court said in a statement. 其实该案早在2013年荷兰法院就已经做出过判决，由壳牌尼日利亚公司承担责任，而母公司壳牌公司不承担责任；但受损农民和环保组织不甘心，又启动上诉程序。而现在荷兰上诉法院裁定有权在荷兰起诉母公司要求承担责任。其中带来的重要启示是：
（1）现在全球各国的环保意识不断加强，环境保护相关法律规定也趋于严格，需要跨国公司密切关注，尤其是原来是外部性的后果可能要转化为内部成本。另外要注意有些国家会使用环境责任、商业贿赂等作为对外国公司的打击方式和谈判筹码，放任你发生，然后再给你致命一击。
（2）该案中虽然行为及后果发生在尼日利亚，但对壳牌尼日利亚公司和壳牌公司的起诉都在荷兰法院，可见在管辖权上不能掉以轻心。
（3）不仅起诉壳牌尼日利亚公司并已获胜诉，并且现在上诉法院又明确表述不排除母公司对尼日利亚公司的过错承担责任，责任链条不断延伸。当然也可能是投资协议中母公司为尼日利亚公司出具了所有责任的担保（但小编以为可能性比较小，否则一审法院不会轻易判决母公司不承担责任），但总体而言跨国公司在法律风险控制上需要给予海外子公司高度重视，包括环境责任，也包括贿赂腐败等。

4. A&O pay rise sparks Firm of the Year debate
With over 2,500 people taking the RollOnFriday Firm of the Year 2016 survey so far, the light and the dark sides of your firms are becoming clear.
One emerging theme is the impact of Allen & Overy's fat pay rises, which, an A&O associate purrs, "went down well". It has not gone unnoticed among staff at the other Magic Circle firms. At Linklaters, which came top of the Magic Circle in last year's survey, staff comment that management "need to get real" and "pay competitive salaries that are actually top of the market, cf. A&O, all US firms". At Slaughter and May, a lawyer comments "Despite significant increases, we are still paid less than Freshfields and A&O". And a Freshfields lawyer suggests that the firm's patented 'career milestone' system really just "keeps all associates on the minimum pay possible (i.e. nearly 2 years PQE and still on £72k)".
So A&O seems the MC firm to beat on remuneration. Except that Clifford Chance staff seem pretty happy: "Pay is good and bonuses seem fair", says one lawyer. The hours "could be better", with "terrible" work-life balance in some departments, but "they are no worse than those at any other Magic Circle firm". (Rollonfriday)

5. Trade talks lead to “death of Doha and birth of new WTO”
For the first time since the round was launched amid great fanfare in 2001, the WTO’s 164 members, ending a conference in Nairobi at the weekend, declined to “reaffirm” Doha’s mandate. The new line in Nairobi, said one senior trade official, amounted to “the death of Doha and the birth of a new WTO”.
It also marked a victory for the US and EU, who alongside other developed economies have argued that clinging to the long-stalled Doha negotiations was making the institution irrelevant in a changing global economy. (Financial Times)

6. How Unions Could Change the Way Uber and Lyft Work
Seattle was the first U.S. city to pass a law allowing drivers for ride-hailing services to bargain collectively. Seattle became the first U.S. city to pass collective bargaining legislation on Monday. Unions pose a new kind of threat to Uber and Lyft's businesses, which connect riders with freelance drivers through a smartphone application. While the companies have been facing legal battles around the U.S. to reclassify drivers as employees and offer benefits, the new Seattle law bypassed that issue in favor of a focus on allowing them to organize into a union, giving drivers more weight in negotiations. A similar bill is expected to be introduced in California as soon as next month, according to the Los Angeles Times. (Bloomberg)

8. Hundreds protest release of New Delhi rapist
Hundreds of protesters gathered in the heart of the Indian capital on Sunday to protest the release of the juvenile who was convicted of raping a young woman in a moving bus three years ago.
“In spite of all our efforts, the juvenile is free today. I regret it deeply,” said Badrinath Singh, the victim’s father, leading the protests. The crowd of protesters shouted, “Shame, shame.” The rapist’s release, he said, was a threat to women’s safety across the country.
Students held placards saying: “No exceptions, no excuses, hang the rapists” and “We have no faith in the judiciary.” Another sign said: “Incredible India. If you are 18, come, rape and walk away.” (The Washington Post)

9. EU data protection reform may promise more than it delivers
Implementing the biggest shake-up to Europe's fragmented data protection laws in two decades may fail to provide companies with the consistency and simplicity that had been promised across the 28-nation bloc.
A patchwork of privacy laws in the European Union, dating back to 1995 when the internet was in its infancy, was criticised for lacking teeth and being interpreted differently across the EU.
To tackle those failings, the EU last week agreed a sweeping overhaul of data protection rules which would introduce a single rule book, fines of up to 4 percent of a company's global turnover and simpler system of enforcement. (Reuters)

JPMorgan Chase has agreed to pay $150 million to public pension funds and individuals hurt by its $6 billion "London Whale" trading loss, Ohio's attorney general announced Monday.
The settlement deal came in a 2012 class-action lawsuit that alleged JPMorgan Chase issued false and misleading statements regarding its trading activity, describing risky and speculative trading strategies as mere "hedges" or "risk management" devices. (ABCNEWS)

11. Massachusetts man charged with fraud in 'Kung Fu Panda' case
A Massachusetts man who sued DreamWorks Animation SKG Inc claiming he had invented the title character in the 2008 film "Kung Fu Panda" committed fraud by back-dating drawings he relied on as evidence, U.S. federal prosecutors said on Monday.
Federal prosecutors in Boston charged Jayme Gordon, 51, of Randolph, Massachusetts, with wire fraud and perjury, asserting that he lied in a 2011 lawsuit against the Hollywood studio by claiming the high-kicking bear named Po infringed on characters he had developed in the 1990s. (Reuters)

12. Former Teachers Accused in Sex Case with Student, 16, Charged Year After Arrest
Two former Louisiana high school teachers accused in a sex case involving 16-year-old student have been formally charged more than a year after their arrest. The Jefferson Parish District Attorney's Office charged Shelley Dufresne, 33, with two counts of carnal knowledge of a juvenile, and 25-year-old Rachel Respess with one count of failure to report the commission of certain felonies, according to reports. The former Destrehan High School teachers were previously accused by authorities of having group sex with the teenager, but the charges brought against the pair on Monday did not accuse Respess of a sex crime, the New Orleans Times-Picayune reported.
