1. Egypt convicts 2 policemen over deadly abuse of detainees

An Egyptian court on Saturday convicted two policemen in absentia, sentencing each to life in prison over torturing a detainee to death and injuring another, as part of a government crackdown on police abuses.

The policemen were convicted after the prosecution presented forensic testimony that detainee Ismail Abdel-Hameed was tortured to death in 2014, Judge Saeed Sabry said. (Findlaw)

deadly:adj. detainee:n. in absentia:(拉)缺席。torture:vt. crackdown:n. prosecution:n. Forensic:adj.

2. Sydney-based CFO stole $10m from company over a decade, police say

A Sydney-based chief financial officer of a multinational company has been charged with defrauding his employer of more than $10 million in an alleged decade-long scam, police say.

Police will allege in court that the 36-year-old man, from Beaumont Hills in Sydney's north-west, siphoned $10.3 million from his long-term employer into bank accounts he personally controlled between 2004 and 2015. (Financial Review)

defraud:vt. alleged:adj. scam:n. siphon:n.

3. Fed-up creditors seek to put US energy's zombies into bankruptcy

Rising financial stress in the U.S. energy sector has prompted some suppliers and vendors to take unusual legal action to collect unpaid debts: forcing struggling companies with billions of dollars in debt into bankruptcy.

Since August, creditors have filed petitions for involuntary bankruptcy against three energy producers with nearly $2 billion in combined debt: Miller Energy Resources Inc, Black Elk Energy Offshore Operations and Energy & Exploration Partners Inc. (Reuters)

petition:n.

4. Slovenia: Same-Sex Marriage Law Rejected by Voters

In a referendum held on December 20, 2015, voters in Slovenia rejected by a margin of 63.54% to 36.46% a law on same-sex marriage and adoption rights that had been passed by the National Assembly in March 2015. CNN reported, however, based on information from Slovenia’s Government Communication Office, that the rate of participation in the referendum was “relatively low, … with just over 36% of eligible voters turning out … .”

The civil society group Coalition for the Good of the Children, which opposed the law, began a petition against it before any same-sex couples were permitted to marry under its provisions and sought court approval to hold a referendum on the new legislation. A referendum held on the same subject in 2012 also resulted in rejection of same-sex marriage. (Library of Congress)

coalition:n.

(Coalition for the Good of the Children)就极力反对此项法律,并获得了法院对举行公投的裁准。

5. Google's Copying of Map Data Didn't Infringe Creator's Copyright

The individual points of interest contained in a Global Positioning System database were uncopyrightable facts, the U.S. District Court for the Northern District of California held Dec. 14.

Magistrate Judge Joseph C. Spero said the traffic condition and speed trap information in the GPS app consisted of objectively discoverable facts, even to the extent it was intentionally seeded with false data to identify infringers.

The database as a whole is copyrightable as a compilation with at least modicum of creativity, the court said following Feist Publ'ns Inc. v. Rural Tel. Serv. Co., 499 U.S. 340 (U.S. 1991). (Bloomberg)

modicum:n. creativity:n.

(Of a work) ineligible for copyright protection either because the work lacks originality or because it is an idea, concept, process, or other abstraction that is not included in one of the eight covered classifications of copyrightable works. 17 USCA §§ 101–106. [Cases: Copyrights and Intellectual Property 4. C.J.S. Copyrights and Intellectual Property §§ 9–10, 16.]

6. Law firms slow to respond to diversification threat of Big Four accountants

Law firms have failed to hit back with equal force to the 'pretty bold statements' made by the Big Four accountancy firms this year as they beef up their legal arms, according to a leading analyst.

Noting the lack of a strong response, Marc Totaro, national manager of professional services at the Commonwealth Bank of Australia, said: 'We're not seeing the same responses from the top legal firms. They're not talking around diversifying their core offerings as well, so I think there's a real challenge there for the legal industry as the larger [accountancy] firms provide an additional source of competition.' PwC, for instance, has stated its intention to become a top 20 international law firm. (Global Legal Post)

beef up:vt.

7. Puerto Rico governor: U.S. backtracking on island's independence

The United States is backtracking from its historic position acknowledging Puerto Rico's right to self-governance, Puerto Rico's governor says in a pending U.S. Supreme Court case over so-called double jeopardy laws.

In a letter to United Nations Secretary-General Ban Ki-moon released on Sunday, Puerto Rico Governor Alejandro Garcia Padilla said Washington is reversing a decades-old understanding that Puerto Rico, while a U.S. commonwealth, governs through its own constitution. (Reuters)

backtrack:vi. reverse:vt. commonwealth:n.

8. Driverless cars could provide golden future for litigators

The prospect of driverless and semi-driverless cars travelling on the streets within a few years is making lawyers ponder the interesting possibilities for litigation work when accidents occur.

Kevin Dean, who is taking claims against General Motors and Takata, said: 'You’re going to get a whole host of new defendants. Computer programmers, computer companies, designers of algorithms, Google, mapping companies, even states. It’s going to be very fertile ground for lawyers.' (Global Legal Post)

ponder:vt. algorithms:n.

9. Massachusetts law firm is accused of suing debtors without 'meaningful attorney involvement'

Massachusetts Attorney General Maura Healey is seeking civil penalties against a debt-collection law firm accused of pursuing cases based on inaccurate or incomplete information.

Healey filed a civil complaint last week against the firm, Lustig, Glaser & Wilson, according to a press release and the Boston Globe. The press release accuses the firm of suing consumers “without any meaningful attorney involvement in the lawsuits.”

The law firm relied on computerized spreadsheets provided by national debt buyers, the press release says. That allowed the firm to process up to thousands of consumer accounts for collection in a day’s time. (ABA Journal)

10. Pentagon thwarts Obama's effort to close Guantanamo

Obama criticized President George W. Bush for having set up the prison for foreigners seized in the "War on Terror" after the Sept. 11, 2001, attacks on the U.S., and then keeping them there for years without trial.

Since Obama took office in 2009, these people said, Pentagon officials have been throwing up bureaucratic obstacles to thwart the president's plan to close Guantanamo.

Negotiating prisoner releases with the Pentagon was like "punching a pillow," said James Dobbins, the State Department special representative to Afghanistan and Pakistan from 2013 to 2014. Defense Department officials "would come to a meeting, they would not make a counter-argument," he said. "And then nothing would happen." (Reuters)

【Thwart】(英 [θwɔːt],美 [θwɔrt]):vt. 【bureaucratic】( 英 [,bjɔːrə'krætɪk; ,bjʊərə'krætɪk], 美 [,bjʊrə'krætɪk] ):adj. 【obstacle】( 英 ['ɒbstək(ə)l] ,美 ['ɑbstəkl] ) :n.

11. Uber-type flight app shuts down after DC Circuit decision

A federal appeals court has rejected an appeal by an airplane ride-arranging app that contended pilots finding passengers through its website didn’t need to have commercial licenses.

The U.S. Court of Appeals for the District of Columbia Circuit denied review in a Dec. 18 decision involving Flytenow, which was “aiming to be the Uber of the skies,” the Boston Herald reports. The app allowed private pilots to post plans for their flights to find passengers willing to share expenses. The Los Angeles Times and Courthouse News Service also have stories on the decision. (ABA Journal)

12. Former Rwandan mayor sentenced to life over role in genocide

A German court sentenced a former Rwandan mayor to life in prison on Tuesday, convicting him after a second trial of participating in genocide for helping organize the killing of some 400 members of the Tutsi minority in 1994.

Onesphore Rwabukombe, 58, was convicted in 2014 of being an accessory to genocide and sentenced to 14 years in prison. Both sides appealed that ruling, and a federal court found that evidence heard at the original three-year trial suggested there was sufficient evidence for a tougher conviction. (Findlaw)

【mayor】( 英 [meə],美 ['meɚ]  ):n. 【convict】(英 [kən'vɪkt],美 [kən'vɪkt]):vt. 【genocide】(英 ['dʒenəsaɪd],美 ['dʒɛnəsaɪd] ):n. 【Tutsi】(['tutsi] ):n. 【accessory】(英 [ək'ses(ə)rɪ],美 [ək'sɛsəri]):n.

13. Indiana courts push ahead with shift to e-filing

Indiana's top courts are pushing ahead with adopting an electronic-filing system that state officials say will eventually give the public free access to online court records statewide.

The Indiana Supreme Court and the state Court of Appeals began offering e-filing in November, and the Indiana Tax Court, will follow in January. The goal is for trial courts in all 92 counties to offer e-filing by the end of 2018; one county has already instituted it and six others will follow in the first half of 2016. (Breakinglegalnews)

【push ahead with】:推动,推进。【institute】(英 ['ɪnstɪtjuːt] ,美 ['ɪnstɪtut] ):vt.

14. Financial services sector is top recruiter of lawyers in 2015

Banks and financial services companies recruited more lawyers in the UK than any other sector, a trend set to continue in the new year.

Banks and financial services companies topped the recruitment list for lawyers last year, according to recruiters Robert Walters. The company saw a 48 per cent rise in job adverts for financial services lawyers as the banks came under pressure from regulators. This compares with a 22 per cent increase in job adverts overall. EMEA CEO Chris Hickey said that he anticipated similar growth in 2016. (Global Legal Post)

【advert】(英 ['ædvɜːt],美 [ædˈvɚt] ):vi.

15. Dubai seeks cause of massive hotel fire at New Year

The authorities in Dubai are trying to find out what caused a spectacular fire to engulf a 63-storey luxury hotel in the city centre on New Year's Eve.

Firefighters managed to subdue the blaze, but part of the Address Downtown Hotel is still smouldering. A BBC reporter says a significant fire is still visible on the 20th floor, where the blaze apparently started.

The tower was evacuated and 16 people were hurt. But a fireworks show went ahead at the Burj Khalifa tower nearby. The Burj Khalifa is the world's tallest building and an iconic symbol of the United Arab Emirates (UAE).  (BBC)

【engulf 】( [ɪn'gʌlf; en-]):vt. 【firefighter】( 英 ['faɪəfaɪtə],美 ['faɪɚfaɪtɚ] ):n. 【blaze】( 英 [bleɪz],美 [blez]  ): n. 【subdue】(英 [səb'djuː],美 [səb'du] ):vt. 【smoulder】(  ['sməʊldə] ):vi. 【evacuate】( 英 [ɪ'vækjʊeɪt],美 [ɪ'vækjuet]):vt. 【iconic】(英 [aɪ'kɒnɪk],美 [aɪ'kɑnɪk]):adj.
